INTRODUCTION

Thank you for choosing Moodshot. By downloading or using Moodshot, these terms will automatically apply to you. Please read them carefully before using the app. You’re not allowed to copy, modify, attempt to extract the source code, translate, or make derivative versions of the app, any part of the app, or our trademarks in any way. The app, along with all trademarks, copyrights, database rights, and other intellectual property rights, still belongs to Moodshot.

The privacy policy can be viewed inside the Moodshot app. Moodshot stores and processes the personal data you provide to offer its services. It’s your responsibility to keep your phone and access to the app secure. Therefore, Moodshot recommends not jailbreaking or rooting your phone, as this could make it vulnerable to malware, compromise its security features, and cause the Moodshot app to malfunction.

THIRD-PARTY CONTENT AND LINKS TO THIRD-PARTY WEBSITES

The Moodshot app uses third-party services to maintain its services. Moodshot relies on third parties to provide information to Moodshot to make its service available to you. Moodshot accepts no liability for any direct or indirect loss you experience as a result of relying on this functionality of the app.

LIMITATION OF LIABILITY

You should be aware that there are certain things Moodshot will not take responsibility for. Some functions of the app require an active internet connection. Moodshot cannot take responsibility for the app not working at full functionality if you don’t have access to the internet or any of your data.

If you’re using the app outside of an area with Wi-Fi, remember that the terms of your mobile network provider will still apply. You may be charged by your mobile provider for data use while accessing the app, including roaming data charges. By using the app, you accept responsibility for any such charges. If you are not the bill payer for the device, please ensure you have permission from the bill payer to use the app.

Moodshot cannot always take responsibility for how you use the app. Ensure your device stays charged; Moodshot does not accept responsibility if your device runs out of battery and you cannot use the Service.

Moodshot may wish to update the app periodically. The app is currently available on iOS. System requirements may change, and you’ll need to download updates to keep using the app. Moodshot does not guarantee updates will always be relevant to you or compatible with your iOS version. However, you agree to accept updates when offered. Moodshot may also stop providing the app and terminate its use at any time without notice. Upon termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app and delete it from your device.

Moodshot reserves the right to change terms and conditions, app features, design, or discontinue its service.

OBJECTIONABLE CONTENT AND ABUSIVE USERS

Moodshot has zero tolerance for objectionable content or abusive users. Content or users deemed objectionable will be blocked by moderators. Objectionable Content includes, but is not limited to:

(i) Sexually explicit materials;
(ii) Obscene, defamatory, libelous, slanderous, violent, and/or unlawful content or profanity;
(iii) Content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights, or that is deceptive or fraudulent;
(iv) Content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition, and/or firearms;
(v) Gambling, including online casinos, sportsbooks, bingo, or poker.

SUBSCRIPTION FEES

Moodshot is committed to ensuring the app is as useful and efficient as possible. Moodshot reserves the right to make changes to the app or charge for its services at any time and for any reason. Moodshot will never charge you without making it clear what you’re paying for.

Prices are based on the U.S. Dollar and may vary in other countries, subject to change without notice. Payment will be charged to your iTunes Account upon purchase confirmation.

The free features can be used free of charge. If you decide to use premium features, Moodshot offers a range of subscription options: weekly, monthly, yearly unlimited packs, consumable shots, or a lifetime pack. Fees are available in the Moodshot app and subject to change.

If you select an Unlimited Pack subscription, it will automatically renew as a rolling subscription at the end of each period (each being a “Renewal”). The method of payment used for Fees will be debited at the end of your current Unlimited subscription.

You acknowledge that Fee changes will not affect your existing Unlimited subscription but may apply to Renewals.

For renewals of all Unlimited subscriptions purchased through Apple iTunes or the Moodshot iPhone/iPad application:

Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours before the end of the current period.
Purchases of Shots in the In-App Purchases category, not a subscription category, cannot be restored by design.

Subscriptions may be managed, and auto-renewal may be turned off by going to the user's Account Settings after purchase.

CHANGES EFFECT

From Weekly Unlimited Pack to Yearly Unlimited Pack – your Yearly Unlimited Pack will be activated immediately after payment is processed, and any remaining time on your Weekly Unlimited Pack will be canceled without a refund.
From Yearly Unlimited Pack to Weekly Unlimited Pack – your Yearly Unlimited Pack will remain active until the end of its current subscription, and your Weekly Unlimited Pack will be activated once it expires.
Your Unlimited subscriptions do not start with a free trial. Free features and premium features can be used similarly, so no additional free trial is necessary. You may cancel your Unlimited memberships anytime by going to your account settings.

CANCELLATION AND REFUND OF SUBSCRIPTION

You can track your Unlimited subscriptions by opening Account Settings after purchase, displaying the expiry date. Moodshot does not provide refunds for Apple App Store payments, as those purchases are managed solely by Apple. Moodshot does not offer refunds or partial refunds outside the refund options stated above.

GOVERNING LAW AND ARBITRATION

These Terms and Conditions, their subject matter, and Moodshot, and your respective rights shall be governed by and construed under the laws of Türkiye, excluding conflict of law provisions. Any dispute arising between you and Moodshot will be resolved by binding arbitration. Unless otherwise required by applicable law, each party shall bear its own attorneys’ fees, regardless of which party prevails in arbitration.

You agree that these Terms represent the entire understanding between Moodshot and you, superseding any previous agreements, promises, assurances, warranties, representations, and understandings, whether written or oral.

TERMINATION OF YOUR ACCESS BY MOODSHOT

Moodshot reserves the right to modify, temporarily suspend, or permanently terminate your access to the Services if Moodshot believes you have breached or acted inconsistently with the Terms. Following termination, your Licence will be automatically revoked, and Moodshot reserves the right to erase all or any information and discard any of your User Content. You agree that Moodshot shall not be liable to you for any modification or discontinuance of the Service. Moodshot accepts no liability for the deletion of information or content. You acknowledge and accept that certain User Content may remain after the termination of your access and that the User Content Licence shall not be revoked or terminated. If you have an active Unlimited subscription when Moodshot terminates your access, you will not receive a refund for any remaining time on your Unlimited subscription.

Moodshot may update the Terms and Conditions periodically. You are advised to review them periodically for changes. Moodshot will notify you of changes by posting the new Terms and Conditions on this page.

These terms and conditions are effective as of 2022-06-01.
